Lewis, Owner: Request a Special Exception Permit in accordance with Article XVII, Article IV, Section 5.21 and Article XV, Section 8.B, of the Caroline County Zoning Ordinance, on a portion of tax map #79-A-2 consisting of 1 acre, more or less, zoned RP, Rural Preservation (with a density of one dwelling unit per ten acres of land). This property is located at the end of Horseshoe Bend Road, just south of Route 699 (Carters Gate Road), Madison Voting District. Proposed Use: Telecommunication Facility. The 2006 – 2026 Comprehensive Plan identifies this property as being located in the Rural Preservation area with a density of one dwelling unit per ten acres of land.

ACTION TAKEN
The Planning Commission recommended approval of this special exception permit subject to conditions (4-1 vote).

4. 2007/2008 – 2016/2017 – CAPITAL IMPROVEMENT PROGRAM THE CAPITAL IMPROVEMENT PROGRAM IS THE PROGRAM FOR GUIDING CAPITAL PROJECTS AND PURCHASES OVER A TEN YEAR PERIOD AND IS BASED ON THE COMPREHENSIVE PLAN. THE CAPITAL IMPROVEMENTS PROGRAM IS DEVELOPED PURSUANT TO TITLE 15-2, CHAPTER 22, ARTICLE 5 OF THE CODE OF VIRGINIA, 1950, AS AMENDED.

This property is located on the east side of Route 1 (Jefferson Davis Highway), approximately 0.17 miles north of the intersection with Route 639 (Ladysmith Road), Madison Voting District. Proposed Use: To amend proffers associated with rezoning request RZ-09-2003 to allow the expansion of an existing shopping center. The 2006 – 2026 Comprehensive Plan identifies this area as being located in the Ladysmith Sub-Area designated as Business, with no specified density.

ACTION TAKEN
The Planning Commission deferred action on this request because of the failure of the applicant to supply renderings which meet the design envisioned by the Ladysmith subcommittee as well as not fully complying with the HCOD provisions and not supplying a proffer statement in time to allow the Planning Commission and staff time for review.
